Eggesford Barton House, The Cider Press and The Gallery BOOKING CONDITIONS
These booking terms and conditions refer to the letting of Eggesford Barton House and the letting of each of the two wings of Eggesford Barton House i.e. The Cider Press and The Gallery. Any reference to either ‘us’ or ‘we’ in these Booking Conditions refers to the owners of Eggesford Barton House, Margaret and Rodney Davies. “You” or “your” are references to the person making the booking (the party leader) and all members of the party. So that you understand the basis of the contract between you and us when you book your accommodation, we have laid out as clearly as possible, the conditions on which your booking is made. Nothing in these conditions affects your normal statutory rights.
1. Your booking:
You must be at least 21 years old when you book your accommodation. Your booking is made as a consumer and you acknowledge that no liability can be accepted for any business losses howsoever suffered or incurred by you. When we issue our written confirmation to you (normally by email) we enter into a contract with you, the party leader, which is subject to these Booking Conditions. Any disputes or queries will be between the party leader and us. The party leader will assume responsibility for the whole party and the compliance with these rules of all party members. We have the right to refuse any booking prior to the issue of our written confirmation, and if we do this we will tell you in writing. When your confirmation is received, the details must be checked carefully. If anything is not correct you should tell us immediately.
2. Party Sizes
Unless different arrangements have been agreed in writing with us, the maximum party sizes are for Eggesford Barton House: 28 people (including children) plus any number babies requiring cots as agreed with us: The Gallery): 12 people (including children) plus any number babies requiring cots as agreed with us: The Cider Press: 16 people (including children) plus any number babies requiring cots as agreed with us.
3. Paying for your accommodation
A deposit of an amount agreed by you and us (normally £500) is payable by cheque or bank transfer at the time of booking. Your booking is not binding until the deposit is received. The balance of the booking cost including any additional charges agreed between you and us e.g. for dogs, must be received by us no later than four weeks before your arrival date. If you book less than four weeks before the arrival date, payment of the total cost is due straightaway.
4. Cancellation of booking by you
If you cancel your booking you must contact us as soon as possible in writing. The booking deposit is non-refundable under any circumstances. However, if you cancel your booking within four weeks of arrival we will make every effort to re-let the property once formal cancellation has been received and if we are able to re-let at the same price the balance will be refunded to you. If we are only able to re-let at a reduced price this sum will be refunded. If we are unable to re-let the full balance will not be refunded to you. We strongly recommend you to take out guest cancellation insurance against cancellation due to ill-health, bereavement etc as the above refund terms are non-negotiable.
3a Changing the date of a booking
Your booking may not be normally moved from one date to another once made, except at our discretion. If you wish to change the booking date you will have to cancel the original booking and the normal cancellation policy will prevail regardless of any subsequent booking made.
5. Cancellation of booking by us
If we have to cancel your booking in advance for any reason you will be refunded the deposit and/or full amount of the booking already paid. If we have to terminate your holiday early for the above reasons you will be refunded part of the booking fee based on the time remaining of the booking. No additional compensation will be payable.
6. Damage, breakages and extraordinary cleaning* to property
£500 to cover potential breakages, damage and/or extraordinary cleaning is payable with the final balance of your rental four weeks prior to arrival. You are responsible to us for the costs to make good any breakages or damage in or to the accommodation and/or any extraordinary cleaning caused by anyone in your party. Any breakages, damage and/or extraordinary cleaning required should be reported to us before departure. After departure, we will inspect the property and notify you in writing if any breakages or damage is evident or extraordinary cleaning* is required with details of reasonable reimbursement. The damages deposit will be returned to you in full or part (if any reimbursement is required) within two weeks of departure. If there is substantial damage, the costs are not limited to £500 and you may be billed for the difference between this and the cost of the repairs.
* Extraordinary cleaning = cleaning requirements on departure as detailed in the Welcome Pack are not met.
7. Accidents, injury and personal property
We shall have no liability to you for the death or personal injury to you or any member of your party. We undergo an annual risk assessment for Eggesford Barton House and the grounds. We advise in particular that:
You must take all necessary steps to safeguard yourself and your personal property. No liability to you is accepted in respect of damage to or loss of such property.
8. Website and advertisements
We aim to ensure that the information and descriptions provided are accurately conveyed on the official website (www.eggesford-barton.co.uk) and any authorised third-party websites or advertisements. There may be small differences between the actual accommodation and its description as we are always seeking to improve services and facilities. Occasionally, problems mean that some facilities or services become unavailable, and if this is the case we will tell you as soon as reasonably practical after we have been made aware of the situation. Similarly, we cannot accept responsibility for any changes or closures to local area amenities or attractions mentioned on the website or advertised elsewhere. There are many unauthorised websites listing holiday cottages. We cannot accept responsibility for the descriptions on these sites.
9. During your stay
Eggesford Barton House (The Gallery and the Cider Press) will be ready for you after 3 pm on the date of your arrival and departure is by 10 am latest on the last day. We are entitled to refuse to hand over the keys to you or to repossess the accommodation if we reasonably believe that any damage is likely to be caused by you or your party and will repossess the accommodation if damage has been caused at any time during your stay. You cannot exceed the party sizes as detailed in 2. nor can you significantly change the makeup of the party during the duration of your stay in the accommodation. You may not carry out any form of trade or business from the property, nor may you sub-let any part of the buildings. The properties are entirely non-smoking and you agree not to smoke in any part of the house. You must allow us or any representative of ours access to the property at any reasonable time during your stay.
We welcome dogs and charge £20 for each dog with the party (max four). Dogs must not be allowed upstairs or on any beds or furniture and in the courtyard. Failure to comply with this may result in an extraordinary cleaning charge against your deposit.
You agree to keep the accommodation clean and tidy as found and leave the accommodation in a similar condition. The following basic level of cleanliness is required on departure; Beds stripped (not mattress protectors). Crockery and cutlery washed/dried and put away or in progress in a dishwasher. Any furniture moved restored to original position. Barbeques clean and fat-free. All bins emptied into large green bin and recycling dealt with as detailed in the Welcome Pack. Failure to meet this standard may result in an extraordinary cleaning charge against your deposit.
14. Problems & Complaints;
If you have any problem or cause for complaint it is essential that you contact us immediately during your stay to give us the chance to resolve it. We value your custom and want you return!
